Niche Extractor — Terms & Conditions

These Terms and Conditions (the “Terms”) govern your access to and use of the Niche Extractor Chrome extension and the website located at https://nicheextractor.com (together, the “Service”). By installing, accessing, or using the Service, you agree to be bound by these Terms.
1) Who We Are & Definitions
“Niche Extractor,” “we,” “our,” or “us” refers to the operator of the Service. “You” or “User” means any person or entity that accesses or uses the Service.
Plans.
Free Version — limited features.
Plus Version — paid subscription with expanded features.
Key Term Labels (Glossary).
FREE — features accessible to any visitor without creating an account or logging in.
FREE* — features available at no monetary cost but require a logged-in account and may be subject to usage limits, quotas, or other conditions.
Credits — store credits tied to a logged-in account. Credits may be usable with or without an active paid plan where applicable; an account is required to hold and spend Credits. Credits represent a usage allowance, not money or stored value.
2) What We Provide
Niche Extractor helps beginner Merch by Amazon sellers analyze Amazon search results. All data displayed is sourced from Amazon based on your inputs. We do not generate keywords, predict trends, or suggest niche ideas, and we are not affiliated with Amazon, Inc. Feature availability may vary by region and device; some features may not function on mobile or outside Amazon.com.
3) Eligibility & Accounts
You must be at least the age required by applicable law (e.g., 13/16+) to use the Service.
You are responsible for the security of your account and must keep your credentials confidential.
Use of disposable/temporary email addresses or false identities is prohibited.
You must promptly notify us of any unauthorized use of your account.
4) Acceptable Use (AUP)
You agree not to:
Violate any applicable laws or third-party rights (including Amazon’s policies and terms).
Copy, scrape at scale, resell, sublicense, or make derivative works of the Service or its outputs, except as permitted by these Terms.
Circumvent technical protections, rate limits, or access restrictions; probe, scan, or test the vulnerability of any system; or interfere with Service operation.
Automate access (e.g., bots, scripts) in a manner that exceeds documented or reasonable usage.
Use the Service to build a competing product or to reverse engineer our software.
We may monitor usage (e.g., request frequency, concurrent sessions, device/IP signals) solely to ensure security, fair use, and compliance with these Terms and our Privacy Policy.
5) Account Sharing & Seats (Strictly Prohibited)
Accounts are single-user unless expressly stated otherwise in your plan. Sharing logins, using “share tools,” reselling access, or making the Service available to third parties is strictly prohibited. We may suspend or terminate accounts for suspected sharing or abuse (e.g., unusual concurrent sessions, device or IP anomalies) without refund.
6) Trials, Subscriptions & Billing
Trials. We may offer a free trial during which no fees are charged. You can cancel at any time during the trial. If you do not cancel before the trial ends, your selected plan will be billed automatically at the then-current price.
Subscriptions. Plus subscriptions renew automatically at the interval shown at checkout until canceled. You can cancel at any time from your account settings or via the link included with your invoice/receipt. After cancellation, Plus access continues until the end of the current billing period. Subscriptions renew automatically unless canceled before the renewal date.
Merchant of Record. Paid purchases may be processed either directly via our integrated payment gateways or by a third-party Merchant of Record such as Paddle. The active payment provider is stated at checkout and on invoices.
Taxes & Receipts. Applicable taxes may be collected by the payment provider. Invoices/receipts and billing management are available through the chosen provider.
7) Refund Policy (No Refunds)
We do not issue refunds after a charge has been made, including for partial periods, upgrades/downgrades, or unused time/features, except where required by applicable law. If you wish to avoid charges after a trial, cancel before the trial ends.
Credits are non-refundable and non-redeemable for cash once purchased or granted, whether or not they are used, except where required by law (see §8). Expired or forfeited Credits are not refundable and cannot be reinstated.
For billing questions, please contact the payment provider shown on your invoice and/or our support (see §20).
8) Credits & Usage
Nature of Credits. “Credits” are units of service access. They have no cash value, are non-transferable, and are not redeemable or refundable except where required by law.
Purchase & Refunds. Once purchased or used, Credits are non-refundable (subject to mandatory consumer rights).
Expiry (purchased/top-up Credits). Unless stated otherwise in your dashboard or order confirmation, Credits granted by purchase or manual top-up expire after 12 months from the date they are added to your account. Unused Credits forfeit on expiry and cannot be restored.
Timezone. Expiry is calculated using the site timezone shown in your dashboard.
Monthly quotas (no rollover). Monthly Credits/quotas reset at the start of each billing month and do not roll over. If we later enable expiry for monthly quotas, the applicable period will be shown in your dashboard.
Consumption order (FIFO). Credits are consumed on a first-in, first-out basis.
Feature costs & rate limits. We may set or adjust per-feature Credit costs, daily/monthly rate limits, and other consumption rules to protect the platform and ensure fair use. Current costs/limits are shown in the product UI.
Promotional/bonus Credits. Promotions may include Credits with different terms (e.g., shorter expiry, feature restrictions). Such terms are shown at issuance and prevail for those Credits. Promotional/bonus Credits are non-transferable and, once issued, are not redeemable for cash.
Visibility & responsibility. Your dashboard displays your balance, monthly quota, and any applicable expiry periods. You are responsible for using Credits before they expire.
Adjustments & abuse. We may correct errors or adjust balances to address fraud, abuse, chargebacks, or legal requirements.
Policy changes. We may update Credit pricing, limits, or expiry rules; changes will be posted in the dashboard and (where required) notified. Changes apply prospectively and do not revive Credits that have already expired.
9) Fair Use & Rate Limits
To protect service quality and costs, we may enforce fair use policies and rate limits (e.g., requests/day, concurrent sessions, API quotas). If your usage materially exceeds normal patterns or plan limits, we may throttle, suspend, or propose an overage arrangement or a plan upgrade.
10) Intellectual Property
All rights, title, and interest in and to the Service (including software, design, UI, text, graphics, and trademarks) are owned by us or our licensors. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your internal business or personal purposes, subject to these Terms.
11) User Content & Feedback
If you submit content (e.g., feedback, text, or uploads), you represent that you have the necessary rights to do so and that it does not infringe any third-party rights or laws. You grant us a worldwide, royalty-free, perpetual license to use feedback to improve the Service. We may moderate or remove unlawful or harmful content.
12) Third-Party Services & Links
The Service may integrate or link to third-party services (e.g., payment processors, AI providers, analytics, trademark checkers). We are not responsible for their content or policies. Your use of third-party services is governed by their terms and privacy notices.
13) Availability, Maintenance & Changes
We strive to keep the Service available, but it may be interrupted for maintenance, updates, or events beyond our control. Features may change or be discontinued. If we permanently remove a core feature of a paid plan and your use is materially impacted, you may cancel your subscription; any applicable statutory remedies will apply (no refunds otherwise per §7). We may update pricing with reasonable notice per your billing cycle.
14) Privacy & Data Protection
We collect and process data as described in our Privacy Policy. We do not sell personal data for marketing. Some processing occurs in your browser while logged in; Plus features may involve server-side processing. We aim to comply with applicable data protection laws (e.g., GDPR). See our Privacy Policy for your rights and how to exercise them.
15) Disclaimers
The Service is provided “as is” and “as available.” We do not warrant uninterrupted or error-free operation. Amazon data is subject to change and may be incomplete, delayed, or inaccurate; we do not control it. To the maximum extent permitted by law, we disclaim all warranties, express or implied.
16) Limitation of Liability
To the fullest extent permitted by law:
We are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, data, or goodwill.
Our aggregate liability for all claims relating to the Service in any 12-month period will not exceed the greater of (a) the amounts you paid to us for the Service in that period, or (b) US $50 if no such payments were made.
These limits apply even if we knew or should have known about the possibility of damages.
Some jurisdictions do not allow certain limitations; in such cases, the applicable limitations will apply to the maximum extent permitted by law.
17) Indemnification
You agree to defend, indemnify, and hold harmless Niche Extractor and its affiliates from claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from your: (a) breach of these Terms; (b) misuse of the Service; (c) violation of laws or third-party rights (including Amazon’s terms).
18) Chargebacks & Disputes
Before opening a payment dispute or chargeback, please contact us to attempt resolution. Unfounded chargebacks may result in suspension of access. Where Paddle acts as Merchant of Record, Paddle’s dispute processes will apply.
19) Export Controls & Compliance
You represent that you are not located in, under the control of, or a national/resident of any country or entity subject to embargoes or sanctions that would prohibit your use of the Service.

21) Governing Law & Jurisdiction
(a) Niche Extractor. These Terms are governed by the laws of the Kingdom of Morocco. The commercial courts of Rabat have exclusive jurisdiction over disputes arising from or relating to these Terms, without prejudice to any mandatory consumer rights under the law of your country of residence.
(b) Merchant of Record (Paddle). For paid purchases processed by Paddle.com Market Ltd as Merchant of Record, the purchase contract is subject to Paddle’s terms and governing law, typically:
US consumers: New York law, with disputes resolved via arbitration in New York.
Other consumers: Law of England and Wales; English courts have jurisdiction, without prejudice to mandatory consumer-protection rights in the consumer’s country of residence.
Business buyers: Law of England and Wales; English courts have jurisdiction.
In the event of any conflict, Paddle’s terms and dispute procedures govern purchases processed by Paddle.
22) Changes to These Terms
We may update these Terms from time to time. Changes take effect when posted to this page with an updated “Last updated” date. Your continued use after changes means you accept the revised Terms.
23) Termination
We may suspend or terminate your access for material breach (e.g., account sharing, abuse, unlawful use) or as required by law. Upon termination, your right to use the Service ends immediately; sections that by their nature should survive (e.g., IP, disclaimers, limitations, indemnity, governing law) will survive.
24) Miscellaneous
Severability. If any provision is found unenforceable, the remainder remains in effect.
No waiver. Failure to enforce a provision is not a waiver of that provision.
Assignment. You may not assign these Terms without our prior written consent. We may assign these Terms as part of a merger, acquisition, or sale of assets.
Entire Agreement. These Terms, together with any plan-specific terms and our Privacy Policy, are the entire agreement between you and us regarding the Service.
Headings. Headings are for convenience only and do not affect interpretation.
